Bottlery Club Membership Rules and Privacy Notice 

  1. General provisions
    1. TThese terms and conditions and privacy provisions (hereinafter – “these Terms and Conditions”) lay down the general terms and conditions of membership in the Bottlery Club and privacy provisions. Provisions in these Terms and Conditions pertaining to personal data protection apply to both individuals who gave their consent to the processing of their personal information for the purposes of registration for and management of membership in the Bottlery Club as well as other purposes, and to those individuals who gave their consent to receive information about the relevant offers and provide feedback about the products, services and quality of customer service. Relationships not covered in these Terms and Conditions, or covered only in part, shall be governed by separate public notices to customers and Lithuanian legislation.
    2. Any individual who fills out and submits this form acknowledges that they have familiarised with these Terms and Conditions and agree to comply with them. UAB MINERALINIAI VANDENYS (hereinafter – the “Organisation”) does not assume any responsibility for a member of the Bottlery Club if they fail to familiarise with, in full or in part, with these Terms and Conditions even though they had been provided with the possibility to do so.
    3. The Organisation reserves the right to change these Terms and Conditions in part or in full, or terminate the Bottlery Club programme with no separate notice to members of the Bottlery Club. Members of the Bottlery Club shall be notified of these changes on the website at www.bottlery.eu and/or in Bottlery stores.
    4. In store every Bottlery Club member shall be subject to the Terms and Conditions valid at the time of use of the benefits provided by membership in the Bottlery Club.
  2. Membership benefits
    1. Membership in the Bottlery Club is beneficial because:
      1. By identifying you we will be able to provide you with information about exclusive and personal special offers on snacks, non-alcoholic beverages and new dining-table accessories, events, and exhibitions.
      2. It is convenient since you will not have to carry any card around with you.
  3. Membership duration
    1. The Organisation reserves the right to terminate the Bottlery Club programme at any time with no separate notice to members of the Bottlery Club. Members of the Bottlery Club shall be notified of these changes on the website at www.bottlery.eu and/or in Bottlery stores.
    2. Any individual who does not provide their consent to the processing of their personal information for the purposes of registration for and management of membership in the Bottlery Club will not be able to make use of the benefits provided by membership in the Bottlery Club.
    3. Should you wish to make use of all the benefits provided by membership in the Bottlery Club, please provide all of the personal information requested in the form.
  4. Personal information processing
    1. The controller of your personal information, i.e. UAB MINERALINIAI VANDENYS, having its office at J.Jasinskio str. 16F, Vilnius, business identification number 121702328, will process your personal information for the following purposes:

    2. For the purpose of carrying out statistical data analysis and market and customer behaviour research as well generating reports required by the business, the Organisation uses automated data analysis. To carry out this analysis we use non-personalised data and do not process your contact information, or other information that might identify you (e.g. name, etc.). Data analysis for statistical, market and customer behaviour research purposes allows us to take important business decisions, such as the formation of an offer that best meets our customer needs, pricing, product layout, new store openings based on the location of our customers, etc. Data analysis operations carried out by us do not have any legal or similar significant impact on you.
    3. For the purpose of providing you with the benefits of membership in the Bottlery Club and personal offers, and/or of achieving other goals of the programme, the Organisation may use automated personal information analysis, including your profiling. We may group and analyse information about you, such as the products you bought, the stores you visited, your city, and/or other patterns specific to you. Data analysis and profiling operations carried out by us do not have any legal or similar significant impact on you. Should you disagree with the profiling of your information aimed at providing you with personal offers, you may choose to withhold your consent or withdraw your consent at any time. Should you choose to do so, you will continue being a member in the Bottlery Club but we will no longer be able to provide you with personal offers.
    4. Upon expiry of the retention period of relevant information and if no updated consent has been received (in circumstances when personal information is processed on the basis of a consent), any personal information provided by you will be destroyed or anonymised. Upon expiry of the retention period of relevant information we will send you a notice 1 (month) month before suspending your membership in the Bottlery Club for reasons of the need to update consent in the case you decide to continue using the benefits of membership in the Bottlery Club.
    5. Personal information processing in relation to video surveillance is governed by this Privacy Policy Relating to Video Surveillance in Bottlery Stores.
    6. All information you might provide to use through the use of social media (including messages, use of Like and Follow buttons, and other communication) is controlled by the manager of the social network. Our website provides links to our accounts on social media. Currently the Organisation is present on: (a) Facebook, privacy statement of which you will find at https://www.facebook.com/privacy/explanation; (b) LinkedIn, privacy statement of which you will find at https://www.linkedin.com/legal/privacy-policy. We do recommend that you read the privacy statements of these third parties and contact service providers directly if you have any questions as to how they use your personal data.
    7. We process your personal information for the purpose of conducting any prize draws, promotions and/or competitions held by us or by our suppliers, if you express your intention to take part in them. We process your personal information in order to determine and announce the winner and deliver the prize. Should you wish to take part in a prize draw and/or competition, you will have to provide us with your personal information. Failure to do so will result in you not being able to take part in the prize draw and/or competition. In the case that you win we will be unable to deliver the prize to you. At the time of delivery of the prize your identity will be checked. If the prize draw and/or competition is organised by our supplier(s), then your personal information may be transferred by us to the supplier(s) and/or in the case that you win your personal information may be published on our platforms (our website, social media sites).
    8. We hereby confirm that any processing operations on your personal information will be carried out by us in compliance with applicable EU and Lithuanian legislation. You have the right to request access to your personal information and find out how it is being processed, request that any personal information you might have provided is corrected, supplemented or destroyed, or ask that further processing be stopped (withdraw your consent). You also have the right to ask that the controller of your personal data limits processing, right to data portability, right to file a complaint with the State Data Protection Inspectorate (contact details are available on the website at www.ada.lt) and the right to object to the processing of personal information provided.     9. We respect your privacy and consequently commit to processing your personal information solely for the purposes described earlier. Your personal information may be transferred to third parties if we are required to do so by Lithuanian law. In cases when required to achieve certain goals, your personal information may be transferred by us to the following third parties:
      • Other subsidiaries of the parent company UAB MV GROUP when they perform functions essential for the achievement of certain goals;
      • Third parties that assist us with the delivery and management of the Bottlery Club programme (for example, organisations that provide advertising and event and game organisation services; organisations that provide newsletter delivery services; software maintenance and support providers). In each case we will limit the transfer of personal information to a data processor to the extent necessary to execute a certain specific assignment or provide a certain service. Data processors we engage will only be allowed to process your personal information in line with our instructions and will not be allowed to use your personal information for any other purpose, or transfer this information to other parties without our consent. Moreover, these processors shall be required to ensure the protection of your personal information in compliance with applicable legislation and written agreements signed with us; and
      • Other third parties when required to achieve a certain goal, for example, to competent public or law enforcement authorities (police or regulatory authorities, etc.) but only if requested by them and when required under the applicable law, or in cases provided for by the applicable law and subject to the procedure laid down therein for the purposes of asserting our rights, ensuring the safety of our customers, employees and resources, and making, enforcing and defending against legal claims.
    10. We will process your personal information within the European Union. At this stage the Organisation does not intend to and does not transfer your personal information to third countries.
  5. Final provisions
    1. A member of the Bottlery Club agrees to promptly notify the Organisation by e-mail at bottlery@mvgroup.eu of any inaccuracies in personal information provided in the form.
    2.
